If a person invests the required amount in an American business and creates or, in some cases, preserves 10 full-time jobs for qualified United States workers, they may be eligible to apply for lawful permanent residence in the United States under the terms of the employment-based, fifth preference (EB-5) immigrant investor classification. This rule increases the needed minimum investment amounts, modifies the selection of targeted employment areas, grants priority date retention to some EB-5 investors, and clarifies USCIS processes for the removal of conditions on permanent residency.
